Terms and license agreement
These terms govern your use of the STAGEVIS macOS application ("the Software") and the Show license. The Software is licensed by d4b Janusz Maciejewski, Wiklinowa 21F
44-151 Gliwice
Poland ("we", "us", the "Licensor"). Contact: contact@stagevis.app.
1. Who sells to you
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries related to payment and handles returns and refunds. The sale of the license to you is concluded with Paddle on Paddle's buyer terms, which apply to payment, taxes, invoicing and refunds. This agreement governs the license to use the Software, which is granted by us.
2. Editions
- Free edition. You may use the complete Software free of charge for any lawful purpose, with a STAGEVIS watermark on the output and at most two live cameras at once.
- Show license. A paid license that removes the watermark and the camera limit, as described on the purchase page.
3. License grant
Subject to these terms, we grant you a personal, non-exclusive, non-transferable license to install and use the Software on Macs that you own or control, for your own live shows, streams, rehearsals and productions, including commercial ones. Output you create with the Software (video, recordings, streams) belongs to you; we claim no rights in it.
4. Perpetual license and the update window
The Show license is perpetual for every eligible build. A build is eligible if it was released on or before the last day of the update window recorded in your key. Your key includes new versions released during 12 months from the date of purchase. After that, the builds you already have keep working with your key indefinitely; later builds require a new Show license (or a later paid update option, if one is offered). We do not disable builds that were eligible when you installed them.
5. Activation and your key
The key is an electronically signed text that is verified inside the Software without contacting a server. It contains the name and email address you used at checkout. Keep it private. You may not publish it or share it beyond the people and machines covered by your license; If a key is published, or the purchase is refunded or charged back, we may list the key as revoked in builds released afterwards; builds released earlier are not affected.
6. Restrictions
You may not: resell, sublicense, rent or lend the Software or your key; remove or alter the watermark in the free edition or circumvent the license check or the camera limit; reverse engineer the Software except to the extent that mandatory law allows despite this restriction. The Software includes third-party open source components that are licensed under their own terms, which take precedence for those components.
7. Updates and availability
The Software checks stagevis.app for new versions when it starts, as described in the privacy policy. We may change or discontinue features in future versions. We aim to keep the website and downloads available but do not guarantee uninterrupted access.
8. Warranty and liability
The Software is provided as described on the website. Statutory warranty and consumer rights that cannot be excluded remain unaffected. Live shows depend on your hardware, network and venue: please test your setup and keep a fallback for important events.
To the extent permitted by law, we are not liable for indirect or consequential loss, lost profit or lost data, and our total liability for any claim relating to the Software is limited to the price you paid for the license. This limit does not apply to liability for intent or gross negligence, to injury to life, body or health, to liability under mandatory product liability law, or to any other liability that cannot be limited by law.
9. Withdrawal and refunds
Consumers have a 14-day right of withdrawal, subject to the digital-content exception. See the refund policy.
10. Termination
If you materially breach these terms, we may terminate your license after notice. You may stop using the Software at any time. Sections that by their nature should survive termination, including the liability limits, survive.
11. Changes to these terms
We may update these terms for future versions and future sales. Changes do not reduce the rights you acquired with a license you already hold.
12. Governing law and disputes
These terms are governed by the laws of Poland, without depriving consumers of the mandatory consumer protection provisions of the country where they live. Consumers may also bring claims before the courts of their country of residence. Please contact us first at contact@stagevis.app so that we can try to resolve any problem directly.
13. Transfer to a successor
We may transfer this agreement and our rights and obligations under it to a successor that takes over the STAGEVIS business, for example a company that replaces the current sole proprietorship. Licenses you already hold keep their scope, and keys that were issued remain valid. The imprint names the current licensor.
14. Contact and seller details
The current licensor and its contact details are named at the top of these terms and in the imprint.
